£35,000 Awarded To Mr M Following Asbestosis Diagnosis
We were instructed on behalf of Mr M in respect of a claim for asbestosis compensation arising out of his diagnosis.
Mr M was employed by John Cashmore Limited and was exposed to asbestos was whilst working initially at Cardiff electric power station and then at Spondon power station in Derby.
At Cardiff electric power station, he was required to dismantle the power station and remove the boilers, pipework, beams and girders, to leave only the shell of the building. Whilst the accessible asbestos lagging had been removed by other contractors before Mr M started work, as he carried out the stripping and dismantling work, asbestos lagging which had previously been hidden was disturbed.
At Spondon power station, he was required to dismantle 6 boilers and their housings. Again, whilst the accessible asbestos lagging had been removed, he again disturbed asbestos which had been hidden.
Court proceedings were issued in order to progress matters. Mr M’s claim settled in the run up to the assessment of damages hearing in the sum of £35,000 on a provisional damages basis, which allows Mr M, or his dependents, to return for further compensation should his condition develop into a more serious asbestos related condition.
